Two companies, the same reported breaches
On 27 October, the Labour Department announced that 派比安洗滌有限公司 and 湊湊(香港)餐飲管理有限公司 had submitted inaccurate full-time local employee numbers and failed to maintain the required 2:1 ratio of full-time local employees to imported workers after importing workers.
The sanction and its scope
Processing of both companies’ submitted scheme applications was suspended immediately. Applications submitted over the following year from the announcement date would not be processed. This is an administrative sanction, not a criminal conviction announcement. The release does not say that all approved quotas in these cases were revoked. The 2:1 requirement in these cases should not be generalised to every industry or application category.
BLJ advice: make staffing checks routine
Review the applicable ratio whenever local employees leave or their hours or departments change. Before reporting, reconcile employee lists with employment and MPF records. If information is inaccurate or staffing may fall short, ask the Labour Department how to address the issue promptly. Do not reuse outdated figures or fabricate records.
What employers can do now
- Assign responsibility for tracking local staffing and hours.
- Reconcile reported figures with employment and contribution records.
- Ask the Labour Department promptly about possible shortfalls or reporting errors.
