What happened
On 23 October, the Labour Department announced that 港深車業服務有限公司, while applying to import drivers, had failed without reasonable grounds to interview a qualified applicant as agreed and had submitted inaccurate local recruitment results.
The sanction in this case
Processing of the company’s submitted scheme applications was suspended immediately. Applications submitted over the following two years from the announcement date would not be processed. This is an administrative sanction, not a criminal conviction announcement. Two years is the sanction for this case, not a uniform period for every breach. The release does not say that all previously approved quotas in this case were revoked.
BLJ advice: check before and after interviews
Before an interview, confirm the time, venue, interviewer and contact details. If changes are needed, contact the applicant promptly and retain genuine reasons and correspondence. Afterwards, record actual attendance and results, then check the information submitted to the Labour Department. Do not record an interview as completed if it never took place.
What employers can do now
- Assign an interviewer and confirm agreed arrangements.
- Keep genuine reasons and correspondence for rescheduling or cancellation.
- Reconcile actual interviews with reported recruitment results.
