Official announcement

On 12 October, the Labour Department announced that two companies had breached local recruitment requirements when applying for imported dishwashers. Processing of their submitted applications was suspended, and applications submitted over the next two years would not be processed.

Different findings in the two cases

The release identifies 盛世投資管理有限公司 as having added conditions without consent, submitted inaccurate local recruitment results and rejected qualified applicants without reasonable grounds. It identifies 何富記麵家(荃灣)有限公司 as having rejected qualified applicants without reasonable grounds. These are administrative sanctions; the release is not a criminal conviction announcement.

BLJ advice: reconcile recruitment records

Interview records and submitted outcomes should agree. Record actual interviews, hiring decisions and reasons, and have the employer check them before submission. Do not report an interview or applicant response that did not occur.

What employers can do now

  1. Align advertising and interview criteria.
  2. Keep accurate interview and contact records.
  3. Have the employer check each recruitment outcome before submission.
